The Aurangabad Municipal Corporation (AMC) has succeeded in taking over the possession of a controversial open space at Ravindranagar (in Tilaknagar) by removing encroachment upon it, today.
The value of land is around Rs 30 crore. Four years ago, the AMC took the possession, but could not succeed due to reasons. Meanwhile, AMC''s three various sections put in their efforts to save the land, and they succeeded in achieving their goal.
While speaking to media persons, the legal advisor Aparna Thete said, " The land admeasuring 3667.86 square metres is of a layout in Tilaknagar-Ravindranagar. One, Pratapsingh Rathod claimed of buying the property from Mir Yavar Ali Khan. Later on, he gave GPA to Satish Runwal. The AMC gave building permission to Runwal, but later on, cancelled it stating that it was an open space. In the meantime, the one-room was illegally built for watchman upon the open space. Ravindranagar Nagari Kruti Samiti''s president Madhavrao Kulkarni challenged the illegal construction in the High Court.
On the other hand, Runwal challenged AMC''s decision of cancelling the building permission. He submitted an appeal which was accepted by the state government. Madhavrao Kulkarni again challenged the state government''s decision in the High Court. Later on, the matter went in the Supreme Court. In defend, the AMC stated that the permission to construct building could not be granted on the said land as it is an open space of the layout. The civic administration then removed the illegal encroachment and took the possession of the said land, four years ago.
Meanwhile, the High Court, in responses to the pleas filed by Kulkarni, directed the AMC to upload its name as the owner of the said land in the property registration card. The High Court also instructed Runwal to file an objection in the District Court, if he has any. Officially, the appeal was to submit within three months, but Runwal couldn''t do so. Hence, the AMC mentioned its name in the PR Card on November 8, 2020, and the estate section took possession of the land on Monday.
The AMC started erecting barbered wire fencing on the land under the supervision of the deputy engineer B K Pardeshi. The additional commissioner R P Nikam, deputy commissioner Aparna Thete and assistant director (town planning) Jayant Kharwadkar along with anti-encroachment squad officials and personnel were present at the time of action.
