HC grants status quo on properties till Friday

Chhatrapati Sambhajinagar:

The Aurangabad Bench of Bombay High Court Justice Mangesh Patil and Justice Prafulla Khubalkar have granted a ‘status quo’ on the properties affected in the widening ofthe Development Plan road from Kailasnagar to MGM Hospital till Friday. The next hearing will be held tomorrow (February 21).

What is the petition

The petitioners Dattatray Garajkar and 6 others through Adv. Siddheshwar S. Thombre stated that the proposed 18-metre road from Kailasnagar to MGM is affecting their homes. After 2016, the municipal corporation issued notices to the petitioners, asking them to submit ownership documents. Accordingly, they submitted the registered sale deed of the land, building permissions, and other relevant documents to the civic administration. Hence the municipal corporation is required to carry out land acquisition for the project, said Adv. Thombre.

Notice and action against illegal construction

Later on, the municipal corporation issued notices to the petitioners stating that their construction was unauthorised and asked them to submit an explanation within 8 days. After submitting the explanation, they were instructed to demolish the construction within 24 hours. On Thursday, the municipal corporation's employees, along with the police, went to demolish the petitioners' homes.

Hence, the petitioners approached the High Court and requested for a stay on the municipal corporation's action. The High Court scheduled the hearing for 2.30 pm, but no representatives from the municipal corporation were present. Therefore, the bench has scheduled the hearing for the petitions on Friday and issued a "status quo" order until then.
