Chhatrapati Sambhajinagar:

In the case concerning the custodial death of Somnath Suryavanshi in Parbhani, the Aurangabad Bench of the Bombay High Court, comprising Justice Sandeepkumar More and Justice Abasaheb Shinde, reserved the judgment on Friday after hearing arguments from both parties on a correction petition filed in the original petition.

Lack of clarity in law

Somnath Suryavanshi’s mother, Vijaya Suryavanshi, had filed a petition seeking the formation of a Special Investigation Team (SIT) and registration of cases against the concerned police officers. Her arguments were presented by Advocate Prakash Ambedkar. After the judicial magistrate first-class (JMFC) recorded a response, there was no clear legal procedure regarding the next steps. The petitioners had requested the court to summon the Home Minister for clarification. However, as this request was not included in the original petition, the court granted a week’s time to file a correction petition.

After the correction petition was filed, the hearing took place on Friday. Advocate Ambedkar argued that the Home Minister should be summoned to make a policy-level decision regarding the matter. On behalf of the government, Amarjit Singh Girase presented counter arguments. After hearing submissions from both sides, the bench reserved the decision on the correction petition.

The original petitioners were represented by Adv Ambedkar, assisted by Advocate Milind Sandanshiv.
