Chhatrapati Sambhajinaga: The Aurangabad bench of the Bombay High Court quashed the case against the educational institution trustee, observing that asking people to take out photos of great men after the programme, does not prove to have hurt religious sentiments.

Permission from the State government is required to prosecute a case under Section 295 (A) of the Indian Penal Code. Since permission was not taken in the present case, Justice Vibha Kankanwadi and Justice Sanjay Deshmukh quashed the case against the society’s trustee.

What was the case?

A case was registered at Majalgaon City Police Station against Ramrao Yashwantrao Mane, the trustee of Gurunanak Public School in Rajegaon, Beed district.

The complainant's daughters are studying in the said school. Photos of great men were kept during the flag-hoisting ceremony on January 26, 2024. The institution's management asked the staff to keep the photos of great men in the office at that time.

A complaint was lodged alleging that the photo placed on the chair was deliberately asked to be removed, hurting religious sentiments. After the hearing, a chargesheet was filed. The trustee of the education society filed an application in the HC through adv Sudarshan Salunke, demanding the cancellation of the case.
