Teacher gets status of trained teacher after 24 years of retirement

Aurangabad Bench of the Bombay High Court comprising Justice S G Mehere and Justice Sandeep Kumar More recently ordered the Chief Executive Officer (CEO) and Education Officer (Primary) of Chhatrapati Sambhajinagar Zilla Parishad (ZP) to grant trained teacher status and pay benefits to a retired untrained teacher.

As per the details, an untrained teacher was eligible to get the status of a trained teacher according to the government's decision. But, he did not get the benefits while in service.

Aurangabad Bench of the Bombay High Court comprising Justice S G Mehere and Justice Sandeep Kumar More recently ordered the CEO and EO (Primary) of Chhatrapati Sambhajinagar ZP to give petitioner a notional salary increase and benefit of the pay grade of a trained teacher as per the government decision of October 4, 1983, within four months from the date of filing the petition until the actual payment.

The retired teacher Narayanrao Laxmanrao Solunke filed a petition through adv Vitthalrao Salgare stating that he was appointed as an untrained teacher in ZP on August 12, 1965. He passed SSC in March 1972. He retired as an untrained teacher on November 30, 2001, as per the age limit. He received a pension and other benefits as per the pay scale of an untrained teacher.

Meanwhile, the government issued a decision on October 4, 1983, granting the status of 'rained teachers to untrained teachers appointed before January 2, 1972. Despite this, the petitioner did not receive the pay grade and salary of trained teachers while in service.

Even after retirement, he did not move the court for many years to get a pension as per the pay scale of trained teachers. However, when some untrained teachers filed petitions, the bench accepted that they were eligible to get the pay scale of trained teachers. Solunke requested the court that he should also get the benefit accordingly.

On perusal of the records, the bench came to the notice that as per the government decision dated October 4, 1983, Solunk was eligible to be called a trained teacher. However, the bench stated that it could not give him the actual benefits of the previous period and passed the above order.
