A bizarre case has emerged from Chhattisgarh, where a man, accused of impotence by his wife in a divorce case, made an unusual demand in court. He insisted that if he was indeed impotent, his wife should undergo a virginity test to prove the truth. However, after the family court rejected his demand, he escalated the matter to the Chhattisgarh High Court, which also dismissed his plea, deeming it unconstitutional.

The High Court ruled that such a demand violated a woman's dignity and fundamental rights. The case stemmed from allegations made by both parties—while the wife claimed her husband was impotent, he accused her of having an extramarital affair with her sister’s husband.

The couple, from Raigad district, married in April 2023 but began facing marital issues within a few months. Eventually, they started living separately. In July 2024, the wife filed for divorce and sought Rs 20,000 as maintenance, alleging that her husband was incapable of consummating the marriage and that her family was misled before the wedding.

In response, the husband accused her of infidelity and claimed she was trying to deny him maintenance. The family court dismissed his allegations and granted maintenance to the wife. Challenging this, the husband approached the High Court, demanding a medical examination of his wife. However, the court upheld that virginity tests are unconstitutional, advising him that if he wished to refute the allegations of impotence, he could opt for his own medical examination instead.
