New Delhi [India], January 28 : The Delhi High Court on Wednesday rejected Baramulla MP Abdul Rashid Sheikh's plea against the framing of charges in a terror case under UAPA. The High court said that the charge order cannot be challenged as it is an interlocutory order.

Abdul Rashid Sheikh alias Engineer Rashid had challenged the order on charges against him in March 16, 2022 and formal framing of charges on May 10, 2022.

Division bench of justices Prathiba M Singh and Madhu Jain rejected the plea of Engineer Rashid against the order of the trial court.

While rejecting the plea, the division bench referred to a similar decision of Delhi High Court wherein 19 appeals against charges were rejected.

The division bench on Wednesday said that charge order cannot be challenged under section 21 of National Investigation Agency (NIA) Act as it is an interlocutory order.

Special NIA court had framed charges against Engineer Rashid under sections related to offences of Criminal Conspiracy, waging war against State, Conspiracy to waging war against the state and several sections of UAPA in 2022.

Engineer Rashid is an elected MP from Baramulla and is undergoing judicial custody.
