CJI SA Bobde has recused himself from the hearing in the Nirbhaya rape case. The CJI has taken this decision citing personal reasons. On Wednesday, the second bench of the Supreme Court will hear the case. A new bench will also be formed on Wednesday. A bench of Chief Justice SA Bobde, Justice R Bhanumathi and Justice Ashok Bhushan was scheduled to be heard on Tuesday on the reconsideration petition of Akshay Kumar Singh, who was convicted in the 2012 Nirbhaya rape case in Delhi.

Akshay Singh is one of the four convicts who has filed a petition to review his death sentence. Earlier, on July 9, 2018, the Supreme Court dismissed the review petition of three convicts Mukesh, Vinay and Pawan in the Nirbhaya gangrape case. The guilty Akshay Kumar has also given many strange arguments in the review application filed in the Supreme Court. The petition said that the air pollution in Delhi is at a dangerous level, it has turned into a gas chamber. The water here has become poisonous and in such a situation where the life expectancy is already decreasing due to bad air and water, then what is the need for the death penalty.
