The Supreme Court today delivered a landmark judgment. The apex court said that under the Domestic Violence Act, a daughter-in-law has the right to live in the house of her in-laws. A three-judge bench headed by Justice Ashok Bhushan has reversed the decision of two judges in the Tarun Batra case.
In the Tarun Batra case, a two-judge bench had said that under the law, a woman cannot live in a property owned by her husband’s parents. Now the three-member bench has changed the decision in the Tarun Batra case and answered 6-7 questions. The court held that the husband has the right not only to separate property but also to the daughter in the shared house. It may be known that the first two-member bench had given the verdict that a wife only has rights over her husband's property. Senior advocate Nidhi Gupta, on behalf of Tarun Batra, argued.
