UPSC Officer Granted Bail in Bribery Case; Pune Court Says “Not Caught Red-Handed

In a case that has sparked discussion across administrative and legal circles, a Special Court in Pune granted bail to 28-year-old Assistant Garrison Engineer Sunil Madhukar Nikam, an officer associated with the Military Engineering Services (MES) in Khadki. Notably, Nikam is a UPSC-qualified officer who cleared the examination on his first attempt.

The order, delivered by Special Judge R.R. Mendhe of the CBI-ACB Court, goes beyond a routine bail decision and reflects the judiciary’s effort to maintain balance while addressing concerns related to the career and reputation of a young public servant.

Background Of The Case

The case stems from a written complaint dated February 3, 2026, alleging a demand for illegal gratification in connection with the clearance of a contractor’s pending bill amounting to approximately ₹9.23 lakh. The work was related to a water supply contract under the MES jurisdiction in Khadki.

Following verification, a trap was laid on February 5, 2026. During the operation, a co-accused Junior Engineer was allegedly caught with ₹2 lakh. Subsequently, Sunil Madhukar Nikam was arrested from his office.

The prosecution opposed the bail plea, citing prima facie evidence and expressing concern that the accused could influence witnesses if released.

Appearing for the accused, Advocate Abhishek Patil presented detailed arguments before the court.

The defence highlighted that Nikam is a UPSC officer with an unblemished record and no prior criminal antecedents. It stressed that under the Prevention of Corruption Act, establishing an offence requires proof of both “demand” and “acceptance” of illegal gratification—elements which, according to the defence, were not demonstrated in this case.

It was further argued that Nikam, in his role as Assistant Garrison Engineer, was responsible only for inspection, quality assessment, and reporting to senior authority, He did not possess the authority to approve or release payments.

The defence also contended that the contractor had failed to meet required timelines and quality standards, and Nikam had submitted an honest report. The complaint, therefore, was allegedly filed with mala fide intent following his refusal to provide a favourable assessment.

Additionally, the defence pointed out procedural lapses, arguing that the arrest did not comply with guidelines under the Bharatiya Nagarik Suraksha Sanhita (previously Section 41A of the CrPC), which require issuance of notice before arrest in offences punishable up to seven years.

It was also submitted that Nikam had cooperated fully with investigators and that all relevant documents had already been seized. Continued custody, the defence argued, would amount to pre-trial punishment and could irreparably harm the career of a young officer presumed innocent until proven guilty.

After hearing both sides and reviewing the case records, the court noted that the alleged offences carry a maximum punishment of up to seven years and that substantial investigation had already been completed. Crucially, the court observed:

“Admittedly, the applicant/accused was not arrested red-handed while accepting the undue advantage of the present crime.”

This observation became central to the decision. The court further noted that the evidence required for investigation had already been secured and that concerns raised by the prosecution could be addressed through strict bail conditions. On these grounds, the court granted bail to Sunil Madhukar Nikam, subject to stringent conditions.
