Court orders to issue notice to home department, DGP, Spl IGP and SP

Aurangabad, July 2:

Justice V K Jadhav and Justice Srikanth D Kulkarni of the Aurangabad bench of the Bombay High Court issued notices to the Maharashtra government, the principal secretary of the home department, the director general of police, the special inspector general of police in Nanded, superintendent of police in Parbhani and the original owner of the vehicle involved in the accident in connection with a petition filed against presenting false accuse in the court by the police in an accident case.

The next hearing on the petition will be held on July 13. According to the petition, on December 27, 2015 Nivrutti Yashwant Salve was returning from a wedding in Jintur with his family when a blue Duster car (MH-15-EB-3731) hit his car. Salve and his family were seriously injured in the accident. He was admitted to the intensive care unit at Parbhani for treatment. A case was registered on Salve's complaint. Meanwhile, the police made a false charge sheet and produced a false accused before the court. He was fined Rs 7,000 and was released. Hence Salve through adv Amarjitsingh Girase and adv Yogesh B Bolkar filed a petition in the court. The matter came to light when Salve sought documents for an insurance claim but was turned away by police. After sending notice through the lawyers, the police handed over a copy of the charge sheet. Salve was shocked when he noticed that statements of many witnesses had discrepancies. The spot panchnama was not done properly. Insurance documents of another vehicle (MH-15-EB-3137) were attached while the actual vehicle was (MH-15-EB-3731). Instead of original accused Vivek Kumar Singh, another driver Datta Magar was shown involved in the accident. The vehicle and person shown by the police were false. After the hearing the court passed the above orders.
