Live-in-relationship betn married, unmarried not permissible, Rajasthan High Court ruling

Aurangabad, June 12:

The Rajasthan High Court (HC), Jaipur has observed that live-in-relationship between a married and unmarried person is not permissible.

One Hemant Singh (31) of Jaipur district was in live-in relationship with a 29 year unmarried girl. Hemant Singh is already married with another woman. He and the girl approached the HC for direction to the police for protection from the parents of the girl.

The HC observed that a live-in relationship between a married and unmarried person is not permissible.

The pre-requisite for a live-in relationship as held by the Supreme Court in D Velusamy versus D Patchaiammal case is that "the couple must hold themselves out to society as being akin to spouses and must be of legal age to marry or qualified to enter into a legal marriage, including being unmarried.” With these observations, the HC dismissed the petition.
