Observing that the victim's medical report clearly indicates signs of assault and therefore bail cannot be granted to the accused, Justice Shailesh P. Brahme of the Aurangabad Bench of the Bombay High Court rejected the bail application of 53-year-old Dattatray Chimanshette, accused of assaulting a 9-year-old girl at Shirur Anantpal in Latur.

What Was the Incident?
The victim girl had gone to the accused's medical shop on November 2, 2025, to buy medicines. The accused took the girl to a room above the shop and assaulted her. He gave her Rs 15 to keep quiet and not tell anyone. The accused was arrested on November 6, 2025, in connection with this case. He has been charged under Sections 64(1) and 64(2) of the Bharatiya Nyaya Sanhita and under the POCSO Act.
The accused had sought bail citing physical ailments; however, medical examination revealed that he was capable of performing sexual acts. Ultimately, taking into account the seriousness of the crime and the age of the victim, the HC bench rejected the accused's bail application. Assistant Government Pleader Preeti V. Diggikar opposed the bail application on behalf of the State Government.
