Five booked on charge of duping for Rs 71 lakh through fake land deal

Acting upon the orders of Judicial Magistrate First Class (JMFC), Waluj MIDC police, have registered an offence against five persons, on a charge of cheating for Rs 71 lakh, through fake documents of land, situated at Wadgaon Shivar.

According to complainant Scaria Mathew Verghese (resident of Waluj Mahanagar), Madanlal Uttamchand Desarda (resident of Raja Bazaar) informed him that a land admeasuring 1 hectares and 52 R (bearing Gut Number 68) is for sale at Wadgaon Shivar. After going through the 7/12 land extract and other documents, he showed interest in buying it. Later on, a meeting to finalise the deal and monetary transaction was held at the house of Madanlal on February 21, 2011.

He learnt that 7 acres and 31 gunthas of land, in Gut No 68, is for sale. Hence, the deal was fixed to buy it at the rate of Rs 34 lakh per acre. Verghese also gave Rs 1 lakh, before two witnesses, to Desarda for Isaar Paoti (agreement to sale deed through a notary).

The complaint stated that he had given Rs 71 lakh to Madanlal, in connection with the land, on different occasions. Madanlal prepared an Isaar Paoti (agreement to sale deed) and handed over the possession to Verghese in 2011. The buyer then erected barbed wire fencing on the plot, tin shed and also fix a board stating the ownership of land. After some time, Verghese noticed that Madanlal delayed signing the sale deed (registration of property). Raising a suspicion, Verghese decided to verify the land documents given to him by Madanlal, only to find that Madanlal had already sold out the same land to Akash Kagliwal before fixing the deal with him. In the meantime, Verghese claimed that the accused also stole away the barbered wire fence, sheds and signboards fixed at the land.

Verghese realised of being cheated, therefore, he pestered Madanlal to give his money back. He then lodged a complaint with Waluj MIDC police station, but no action was taken upon his complaint. Verghese then appealed before the JMFC, Aurangabad. Acting upon the court orders, Waluj MIDC police station has registered an offence against Madanlal Uttamchand Desarda, Sushila Desarda, Anurag Desarda (all residents of Raja Bazaar), Ashwin Jainarayan Baheti (resident of Cidco) and Vijay Popatlal Jain-Bokadiya (resident of Aurangpura). Under the guidance of police inspector Sandeep Gurme, the PSI Sandeep Shinde is investigating the case.
