Chhatrapati Sambhajinagar:
Observing that no mother would stake her daughter’s dignity to file a false complaint, and noting that the victim’s medical report clearly indicates assault, the Aurangabad bench of the Bombay high court has rejected the bail plea of a 53-year-old accused. Justice Shailesh P. Brahme dismissed the application of Dattatray Chimanshette, accused of assaulting a nine-year-old girl in Shirur Anantpal in Latur district.
What was the incident?
The minor victim had gone to the accused’s medical shop on November 2, 2025, to buy tablets. The accused allegedly took her to a room above the shop and assaulted her. He reportedly gave her Rs 15 to prevent her from disclosing the incident. The accused was arrested on November 6, 2025. A case has been registered against him under sections 64(1) and 64(2) of the Bharatiya Nyaya Sanhita and under the POCSO Act.
The accused had sought bail citing physical illness; however, medical examination established that he was capable of committing the offence. Considering the seriousness of the crime and the age of the victim, the bench rejected the bail plea. Assistant public prosecutor Priti V. Diggikar opposed the bail application on behalf of the state.
