It remains to be seen what the Indian Constitution says in this regard. It remains to be seen whether a Dalit Muslim can get a job through the reservation?

Sameer Dawood Wankhede is a Muslim by birth and has got an IRS job from Dalit or Scheduled Caste. While making this allegation, Malik has also submitted Wankhede's marriage photo, certificate, and birth certificate.

India is a secular country. The Constitution of India gives freedom of religion to the people and also guarantees fundamental rights. By law, there is a 15 percent reservation in government jobs for the Scheduled Castes. This provision is from 1950. This has been changed twice.

The first research was done in 1956 and the second in 1990. According to this, no person other than a Hindu, Sikh, or Buddhist will be considered a member of Scheduled Caste. However, a Supreme Court order has said that Muslims are Dalits.

The Constitution of India gives reservations not on the basis of religion but on the basis of caste. However, some states as well as the central government have given job reservations to the Muslim class. This reservation is in the form of backward or ultra backward class, not a Muslim.

This makes it clear that no Muslim can claim a reservation from the Dalit or Scheduled Caste quota. This is the allegation made by Nawab Malik against Sameer Wankhede.
11 / 13
The Supreme Court had ruled in a case in 1950. If any person wants to avail of the benefit of reservation, he has to submit a certificate stating that he is a Scheduled Caste by birth.

Children born out of interracial marriage will have to go to their father. If their mother is a Scheduled Caste, then the children will have to prove that they have been nurtured as members of the ACC.

If the allegations made by Nawab Malik against Sameer Wankhede are proved true, then Wankhede will have to resign. Not only this, if a case will be filed against them then their salaries, allowances, etc. will also be recovered.
