HC cancels teachers termination order

Aurangabad, Nov 25:

The Aurangabad Division Bench of Bombay High Court comprising Justice S V Gangapurwala and Justice R G Avchat recently cancelled the termination orders of the petitioners five assistant teachers issued for not joining at the post where they had transferred. The bench further mentioned in the order to pay the outstanding salaries of the teachers from July 2019 to till date on 50 percent rate.

The assistant teacher of Swami Vivekanant Academy at Chikalthana, Mahendra Chavan and others were demanding salaries as per the pay scale and other allowances since since 2012. Their demand was sanction as per the order of the division bench issued on March 20, 2017. However, the schools due to dissatisfaction against them transferred them at various places. However, the government-sanctioned posts were not available at the places of the transfer. Hence, the division bench cancelled the transfer orders on August 8, 2019. Still, the school terminated the services of the teachers on July 1, 2019 without informing the petitioners and the division bench, instead filed a review petition requesting to cancel the order regarding the transfers. However, the bench rejected the review petition.

On behalf of the petitioners, Adv B L Sagar Killarikar brought to the notice of the court that the school is not paying according to the sixth pay commission''s recommendations. The teachers were given only Rs 15,000 per month. Hence, the petitioners should get 50 percent salaries as the schools are closed from March, and their families are suffering, he mentioned.

As per the order, the teachers have resumed the services, and the school has paid their salaries.
