HC permits petitioner to file fresh online registration for medical admission

The Aurangabad Bench of Bombay High Court comprising Justice S P Deshmukh and Justice S D Kulkarni has granted permission to petitioner Zamzam Bushra for filing fresh online registration for medical admission. The petitioner did not have a domicile certificate at the time of registration, therefore, she mentioned that she is not a domicile of Maharashtra.

Meanwhile, CET Cell''s lawyer Adv Mrugesh Narwadkar brought into the notice of the court, " The varsity will consider the admission of the petitioner as valid after she takes admission in a college and submits the domicile certificate. Presently there is no need for a domicile certificate during online registration."

During the hearing, it came to notice that Zamzam Bushra''s parents, both are Indians. However, she was born in Saudi Arabia and completed her education abroad till 7th standard. Her mother is a domicile of Maharashtra. The family owns property in Aurangabad. Meanwhile, the petitioner has been staying and taking education in Maharashtra since 2015. She completed her schooling from 8th to 12th standard in Aurangabad. However, Bushra does not have a domicile certificate. However, as per rule, the domicile certificate is issued to a person staying in India for ten years. Hence after going through all the aspects, the bench gave the above verdict. The petitioner also pleaded that she should be given admission from Maharashtra quota.

Adv Taher Ali Quadri pleaded on behalf of the petitioner and the assistant government pleader Bhushan Virde represented the state government.
