Temporary relief to teachers without TET

Chhatrapati Sambhajinagar: The Aurangabad bench of the Bombay High Court gave a big relief to teachers who have not qualified the Maharashtra Teacher Eligibility Test (Maha TET).

HC bench comprising Justice Kishore Sant and Justice Sushil Ghodeswar gave an interim order to include the names of the concerned teachers in the promotion list, subject to the final outcome of the pending petitions.

Although the orders have given temporary relief to the concerned teachers, their promotion will depend on the final decision. It is also mandatory for them to obtain a ‘TET’ qualification within a period of two years.

What is case?

Petitioners Raghunath Jhaware, Dhansingh Rajput and others are currently working as teachers under Ahilyanagar Zilla Parishad (ZP).

They have not yet obtained the ‘TET’ qualification. However, as per the order given by the Supreme Court (SC) on September 1, 2025, a period of two years was given to teachers without ‘TET’ qualification. The SC had given relief on the condition that they should pass the ‘TET’ during this period.

Meanwhile, the Ahilyanagar ZP started the promotion process. The names of the petitioners were not being considered for promotion due to a lack of TET qualification.

While the SC had given a period of two years, the petitioners have requested that the promotion process be stayed until August 31, 2027. Adv R A Shinde is acting on behalf of the petitioner.

Observations of Bench

During the hearing, the Aurangabad Bench noted that it is indisputable that the petitioners do not have the ‘TET’ qualification at present.

However, referring to the order given by the Nagpur Bench on February 12 2026, stating that interim directions were given to include the names of the petitioners in the promotion list in a similar case, the Aurangabad Bench also ordered to issue notices to the respondents in both the petitions. The next hearing on the petitions has been fixed for March 23, 2026.
