Maharashtra: Governor to seek legal advice in regards to CMs appointment as MLC

With all elections postponed due to the coronavirus pandemic, the Maharashtra government on April 8 passed a resolution requesting Governor Bhagat Singh Koshyari to nominate Chief Minister Uddhav Thackeray as a Member of Legislative Council, official sources said.

However, no decision has been made yet and the governor will seek legal advice on this matter, as per sources. If the Governor rejects the Cabinet proposal, Thackeray will have to step down from the Chief Minister post. Which will result into falling of the Maha Vikas Aghadi government.

The state cabinet, presided over by Deputy Chief Minister Ajit Pawar passed the unanimous resolution of the three Maha Vikas Aghadi allies Shiv Sena, Nationalist Congress Party and Congress.

Thackeray, who took oath as the CM on Nov. 28 last year, is currently not a member of either House of the legislature.

As per the Constitution, he must get elected to either House of the legislature the Legislative Assembly or Legislative Council within six months to continue in his post.
