“Human Teeth Cannot Be Considered Dangerous,” Says Bombay High Court

While quashing an FIR filed on a woman's complaint against her in-laws, the Bombay High Court said that human teeth cannot be considered as a dangerous weapon. The complaining woman alleged that her sister-in-law bit her, reported the News Agency PTI. In the medical certificate of the complainant, it was mentioned that there was only a simple cut caused by teeth marks, said Justices Vibha Kankanwadi and Sanjay Deshmukh of the HC's Aurangabad bench in the court order dated April 4.

According to the FIR filed in April 2020 in response to the woman's complaint, one of her sisters-in-law bit her during a fight, injuring her with a potentially harmful weapon.

The suspects were charged with employing dangerous weapons to cause harm, harming someone, and causing injury under the appropriate provisions of the Indian Penal Code. According to the court's ruling, "Human teeth cannot be said to be a dangerous weapon." It dismissed the FIR and granted the accused's motion.

The HC stated that in order for section 324 of the Indian Penal Code (causing hurt with a hazardous weapon) to be applicable, the harm must be caused by an instrument that has the potential to cause death or serious injury. According to the complainant's medical records, the court stated that the complainant's teeth marks only caused little discomfort, reported PTI. The court also noted that there was a property dispute between the accused and the complainant.Open in app
