Plea for implementing EWS reservation in TN, Karnataka filed in SC

A petitioner on Monday approached the Supreme Court seeking implementation of reservations in jobs and other benefits granted to the economically weaker sections in Tamil Nadu and Karnataka.

Advocate G.S. Mani has filed the public suit as Tamil Nadu and Karnataka did not show any action in implementing the 103rd Constitutional Amendment Act, 2019 providing 10 per cent reservation for economically weaker sections (EWS).

In his public interest litigation, Mani sought direction to the Tamil Nadu and Karnataka to make an appropriate special provision for the advancement, reservation of appointments or posts, and admission to educational institutions in favour of EWS.

The advocate said these two states have not implemented nor enforced the aforesaid Constitutional Amendment Act, 2019.

However, he said that his demand should not disturb the existing 69 per cent and 70 per cent reservation granted to schedule castes, tribes, backward and other deprived classes in Tamil Nadu and Karnataka.

Mani has also demanded special provision for the advancement of economically weaker sections in the admission process in private educational institutions.

He has sought implementation of Article 15 (6) and 16(6) of 103rd Constitutional (Amendment) Act, 2019 which permit the state government to provide for special provisions and reservations to economically weaker sections.

"The rights of reservation for economically weaker section of persons other than the section of persons (reservation under the category of Scheduled Caste, Scheduled Tribe, Backward Classes, Other Backward classes and Most Backward Classes) under 103rd Constitutional Amendment under Article 15 (6) and 16 (6) in Part-III of the Constitution is not only a constitutional right but also is a fundamental right under part III of the Constitution," the plea said.

Therefore, Mani sought the apex court's intervention to enforce the fundamental rights of reservations for the economically weaker sections.
