The Supreme Court has dismissed petitions seeking a review of its December 2023 judgment upholding the abrogation of Jammu and Kashmir's special status under Article 370 of the Indian Constitution. The 5-judge bench, comprising Chief Justice DY Chandrachud, Justices Sanjiv Khanna, BR Gavai, Surya Kant, and AS Bopanna, dismissed the review petitions in the chamber, stating that there was no apparent error in the judgment delivered on December 11, 2023.
In an order passed on May 1, the bench noted, "Having perused the review petitions, there is no error apparent on the face of the record. No case for review under Order XLVII Rule 1 of the Supreme Court Rules 2013. The review petitions are, therefore, dismissed."
While affirming the Presidential Orders that revoked the special status of Jammu and Kashmir, the Court refrained from ruling on the constitutionality of the J&K Reorganisation Act. This decision was based on a statement by the Solicitor General assuring the restoration of J&K's statehood at the earliest. The Court has set a deadline of September 30, 2024, for the holding of elections to the legislative assembly of J&K.
The Court also approved the creation of Ladakh as a separate Union Territory from Jammu and Kashmir, asserting that Parliament has the authority to carve out a Union Territory from a State without consulting the State assembly.
