Court denies police to take any action against youth Atul Aavtade who married twin sisters

Last week, there was a big discussion about twin sisters getting married to the same young man. Atul Autade, a young man from Solapur, married two identical twin sisters in the same mandwa. The photos of this wedding went viral on social media.

After seeing Atul and Rinky-Pinky's wedding photos, many made memes on it. Not only in the state, but all the media in the country took notice of this incident. After that, husband Atul got into a lot of trouble for marrying 2 girls at the same time.

A complaint was registered against Atul in Akluj police station. After that, the police registered a case and took the matter before the court. But now, due to the important comment given by the Solapur court in this case, Atul has got a big relief.

The court has denied permission to interrogate Atul in this case. A case was filed against Atul for marrying twin sisters. We then went to court to get investigative powers. But the judge refused to investigate the case citing Section 18, the police said.

In this case the complainant means the aggrieved party i.e. the concerned family member. But the complainant is a third person and therefore cannot take cognizance of the petition. Therefore, it is clear that no action will be taken against Navardev Atul in this case.

Twin sisters living in Mumbai have been accustomed to living together since childhood, so both of them chose the same life partner. She decided to marry Atul Autade, a young man, and the marriage took place at Akluj, Solapur.

However, on the second day of the wedding, the happiness of the bridegroom and the twin sisters came to an end. A complaint was filed by Rahul Phule from Malewadi, and the police registered a non-complaintable offense (NCR) under Section 494 of the Indian Penal Code 1860 against Navardeva.

According to Indian Penal Code 494 second marriage cannot be performed while the husband or wife is alive. Doing so can result in 7 years imprisonment. According to the Hindu Marriage Act, it is a crime for one man to marry twice. Based on this law, a case was registered against Atul.

But only husband and wife have right to complain under section 494. Since marriage is a matter strictly limited to two persons, the law does not give the aggrieved person the right to complain in it.

Since Rahul Phule is a third party, his complaint is not valid. Atul's 2 wives have no complaints about the marriage. Therefore, as this is a legal embarrassment, the court decision made it clear that Atul cannot be prosecuted.
