High Court refrains appointment of talathis under EWS category!

Aurangabad, Dec 21:

The Aurangabad Bench of Bombay High Court comprising Justice S V Gangapurwala and Justice S D Kulkarni had granted an interim order preventing the administration from the appointment of candidates scoring less than the petitioners under Economically Weaker Section (EWS) category, till the next order. The court also clarified that the candidates scoring more than the petitioners could be appointed stated the court verdict given on December 18. The next hearing upon the petition will be held on January 14, 2021.

The petitioners Sheetal Jhirpe and Varsha Akat applied for the post of talathis under Special Economic Backward Category (SEBC) quota. Presently, there is an interim stay of the Supreme Court on the SEBC quota. As a result, the petitioners claimed that they possess EWS certificates. Hence, if they are appointed under this category, then they will submit an undertaking that they will not claim for reservation under SEBC.

Meanwhile, the state government has not yet decided upon granting facility to SEBC candidates under the EWS category. Hence the acting government pleader D R Kale sought time to submit the reply. Accordingly, the High Court gave the above order.

Adv S S Kulkarni (on behalf of Adv Snehal Jadhav) and Adv V S Kadam represented the two petitioners, while the government pleader Sujit Karlekar pleaded on behalf of the state government.
