Aurangabad division bench of Bombay High Court comprising Justice T V Nalawade and Justice M G Shevlikar on Tuesday (December 8) ordered that the then commissioner of police and the ASI Gorakh Chavan (posted here in 2017) should give Rs 7 lakh to the petitioner Ram Babanrao Waregaonkar as compensation. The order further state that the government should get mentioned amount deposited in 45 days and if the amount is not deposited in this period, 8 percent interest will have to be paid. The government should conduct an inquiry and establish the responsibility of the mentioned officers regarding the money and can take the action accordingly, the order stated.
Waregaonkar stated in his petition that he had given Rs 6.5 lakh to Sanjay Ambhure and the transaction was notarized. Ambhure had given a post dated cheque to Waregaonkar to return the money.
However, ASI Gorkh Chavan called Waregaonkar at Collector office and threatened him to register a complaint against him and took the notary papers and cheque and took in written from Waregaonkar that the transaction between Waregaonkar and Ambhore was cancelled. Later, he submitted application in this regard to the commissioner of police but no action was taken in this regard. The bench following a petition ordered the commissioner of police to conduct an inquiry and he gave the decision that there is no substance in the complaint. Hence, Waregaonkar challenged the decision through a criminal petition at the division bench. Senior counsel V D Sapkal and Ad. Sandeep Sapkal appeared for the petitioner, senior counsel Rajendra Deshmukh for Chavan and public prosecutor S D Ghayal for the government.
